Wills, Powers of Attorney and Estate Planning
It is essential that everyone should have a current Will and Enduring Power of Attorney. If already have one, we recommend that they be regularly reviewed and updated as your life circumstances change.
Our lives and those of our children and grandchildren are becoming increasingly complicated and you need to ensure that your legacy (however large or small) is protected for your rightful beneficiaries and to try to minimise the potential for a claim against your hard earned Estate assets.
Biddle Lawyers provide fixed fee services for Wills and Enduring Powers of Attorney and you will consult with an experienced Solicitor to ensure that your individual needs are identified and properly reflected in your documents. We consult with your Accountants and Financial Planners and other professionals to bring a wholistic approach to the protection and distribution of your assets.
An Enduring Power of Attorney is a powerful document through which you grant power to a trusted loved one, adviser or friend to make financial and/or health related decisions on your behalf.
We suggest an Enduring Power of Attorney as opposed to a general Power of Attorney as it does precisely that, endures in the event that you were to become mentally or physically incapacitated. A general Power of Attorney becomes null and void should this occur.
You can limit the power you give so that it is used only in the event that you lose the capability to make the decisions yourself, or it can be an open-ended power.
We can also advise you on the drafting and use of an Advanced Health Directive.
